The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred upon her by sections 30(1) and (3)(a), 32(1) and 63(1) of the Clean Air Act 1993. (See footnote 1)

In accordance with section 30(2) of that Act, she has consulted persons appearing to her to represent manufacturers and users of motor vehicles, persons appearing to her to represent the producers and users of fuel for motor vehicles and persons appearing to her to be conversant with the problems of air pollution.

Citation and commencement

1. These Regulations may be cited as the Motor Fuel (Composition and Content)(Amendment) Regulations 2008 and shall come into force on xx 2008.

 2. In regulation 7(1) of the Motor Fuel (Composition and Content) Regulations 1999 (See footnote 2) 22, for “regulations 4 and 5” substitute “regulations 4, 5 and 5A”.

EXPLANATORY NOTE

 (This note is not part of the Regulations)

These Regulations amend regulation 7 of the Motor Fuel (Composition and Content) Regulations 1999 (the “1999 Regulations”) in order to permit the Secretary of State to act pursuant to article 7 of directive 98/70/EC (OJ No. L350, 28.12.1998, p. 58) in so far as it relates to the requirements of article 4(5) (as inserted into directive 98/70/EC by   article 1(3)(b) of directive 2003/17/EC (OJ No. L76, 22.3.2003, p. 10)). Article 7 provides that fuel specification requirements (including those set out in article 4(5)) may be relaxed if exceptional events cause a sudden change in the supply of crude oils or petroleum products. The Motor Fuel (Composition and Content) (Amendment) Regulations 2003 transposed other parts of directive 2003/17/EC in so far as they related to gas oil.  These Regulations permit the Secretary of State to grant an exemption from regulation 4(5) of the 1999 Regulations where appropriate.

A full impact assessment has not been prepared for these regulations as they have no impact on the costs of business or the voluntary sector.

This Explanatory Note incorporates the Transposition Note that would otherwise be required.
